Uncontested Divorce Achieves

Divorce, or dissolution of marriage, creates emotional situations, particularly if children resulted from the marriage. If both you and your marriage partner agree on all issues related to the dissolution, this would then be considered an Uncontested Divorce. In this situation, both partners have agreed on issues such as division of property, division of debts, Child Custody/Parenting Plan and Visitation/Timesharing issues, Child Support, Spousal Support/Alimony, etc. This is the easiest, least complex or time consuming type of Divorce and can often be handled at a flat rate fee. In a situation where both parties are not in total agreement, this is considered a Contested Divorce and it must be dealt with quite differently. A Contested Divorce can become very complex, with lengthy litigation involved.

Divorce Requirements in Florida

Florida State Law requires that at least one of the parties was a resident of Florida for at least six months prior to the petition being filed, and proof of residency is required.

Per Florida Statute, Chapter 61.052, there are two grounds for Divorce:

• An irretrievably broken marriage, or
• Mental incapacity of one of the spouses (evidence of mental incapacity must be substantiated.)

Even in the best of situations, several aspects of the dissolution must be worked out and any disputes resolved. While an Uncontested Divorce does not require a trial, this does not mean that the court doesn’t play an integral part. Any Divorce in Florida must have correct and specific legal proceeding so that a valid Divorce decree can be issued.
